Biography

Benjamin Pinczewski graduated Summa Cum Laude from SUNY Stonybrook, after which he attended St. John’s School of Law, where he quickly became the youngest Civil Trial competition winner in the school’s history. After graduating in 1985, he worked for Snitow & Pauley in New York City, focusing on complex civil litigation, white collar criminal defense work and real estate transactions.

Mr. Pinczewski opened his own law firm in 1990. Initially, he primarily represented insurance carriers, providing expert defense work in negligence cases, personal injury lawsuits and no fault collection matters. He continued to develop his skills and expertise in representing individuals and entities in complex civil business litigations. He further developed and enhanced his courtroom skills, trying numerous cases to verdict. Most importantly, he gained invaluable insight into insurance carriers’ perspectives on cases, what methods they use to analyze and assess the case value, and the tricks they use to defend a claim.

In 1997, Mr. Pinczewski decided to forgo defense work, instead focusing on Plaintiffs who were injured in motor-vehicle accidents, slip and falls, and workplace accidents. With his vast inside knowledge of how insurance carriers defend and assess claims, as well as his trial experience, he is able to routinely recover excellent awards, verdicts and settlements on behalf of accident victims. He also began representing doctors in regulatory matters while drafting agreements to properly structure their practices and to best protect their interests. Mr. Pinczewski is a zealous advocate on behalf of his clients, as well as the entire community. His passion – as well as his commitment to doing the right thing – resulted in him being featured on an episode of ABC hit show, “What would you do?“. Unscripted and unaware he was being recorded, Mr. Pinczewski fiercely protected and stood up for a couple being discriminated against. Since that time he has expanded the practice to include Civil Rights and all types of discrimination cases and has spoken at conferences and panels on these issues and recognized for his passion, expertise and zealous advocacy. Mr. Pinczewski has been recognized as a “Super Lawyer”, a lifetime member of Who’s Who and top rated by AVVO for the past 10 years.

Mr. Pinczewski is married and has an adult son. He is a member of the New Jersey Personal Injury Protection (PIP) Advisory Counsel. He is very active in Brooklyn charities, he judges the NYC Mock Trial High School competition, and serves as a Judge for Generation Citizen’s Civics Day events. He is the Executive Director of the Borough Cup, a not-for-profit organization that has brought youth baseball to inner city kids culminating in championship games held at Yankee Stadium and MCU ballpark. His outstanding community service has been recognized by The Office of the Mayor, Congressman Hakeem Jeffries and Yvette Clark as well as by the NYC Public Advocate, the NYS Senate and Assembly and the NYC Council. He is licensed to practice law in both New York and New Jersey.

Mitchell B. Shpelfogel graduated from Hofstra University School of Law at 22 years old, the youngest graduate in the school’s history. Mr. Shpelfogel began his legal career as Senior Court Attorney to a New York Civil Court Judge, after which he joined Pinczewski & Shpelfogel, P.C. as a partner in 2008. Since his joining Pinczewski & Shpelfogel, the firm’s practice has grown exponentially, serving diversified clientele in various litigation and transactional matters.

Mr. Shpelfogel is a recognized leader in the field of real estate law. He has been noted by Crain’s New York and The New York Law Journal as serving as counsel to the largest multi-family residential transaction of the year in Brooklyn, New York. He is renowned for his expertise in multi-family real estate and his legal acumen. Mr. Shpelfogel has been a repeat panelist at New York real estate summits, presenting on the topic to hundreds of attorneys and real estate professionals.
